By virtue of this contract concluded between the two parties whose complete details are indicated in the attached contracting form, referred to herein as "the First Party" (the hosting service provider) and "the Second Party" (the client), collectively referred to as "the two parties". In accordance with the provisions of the Egyptian Civil Law No. 131 of 1948, the Commercial Law No. 17 of 1999, the Personal Data Protection Law No. 151 of 2020, the Combating Cyber Crimes Law No. 175 of 2018, the E-Commerce Law No. 15 of 2022, and the laws and regulations in force in the Arab Republic of Egypt. This agreement aims to organize the data hosting relationship between the First Party (the hosting service provider) and the Second Party (the client), whereby the hosting provider commits to providing storage space and technical infrastructure for storing the client's data and electronic files, securing them, and making them accessible, while ensuring performance levels and service continuity, all within a framework of security and confidentiality, while defining the rights and obligations of each party, data protection mechanisms, and conditions for compensation and termination, in accordance with the provisions of Egyptian laws governing the protection of personal data and combating cyber crimes. The two parties have agreed as follows:
Article (1) Definitions of the Contract
1- The following words and phrases—whenever used in this contract—shall have the meanings specified next to each of them, unless the context requires a different meaning:
2- Contract: Refers to this data hosting agreement in its entirety, including its terms and annexes, with its preamble considered an integral part thereof.
3- Hosting Provider: The first party in this contract, which is the provider of data hosting services and technical resources, licensed to engage in this activity.
4- Client: The second party in this contract, which is the natural or legal person benefiting from the hosting service, and who uploads data to the hosting provider's servers.
5- Data: All files, information, programs, images, videos, texts, databases, and digital content that the client uploads or stores on the hosting provider’s servers, including personal data.
6- Personal Data: Any data related to a specific or identifiable natural person, subject to the provisions of Personal Data Protection Law No. 151 of 2020.
7- Servers: The devices, systems, software, and technical infrastructure provided by the hosting provider for storing and making the client’s data accessible.
8- Contract Duration: The period during which the hosting provider is obligated to provide the service, as specified in Article (3) of this contract.
9- Hosting Fees: The amount that the client is obligated to pay to the hosting provider in exchange for the services, as specified in Article (5) of this contract.
