Chapter One: General Provisions

1. Introduction and Purpose

This Policy (the “Policy”) sets out the rule applicable to amounts paid for the services, subscriptions and credits provided by Wthaiq, and states in express and unambiguous terms that such amounts are final and non-refundable once the service has been delivered, and specifies exhaustively the exceptional cases in which an amount is returned because of a collection error or a failure to deliver.

The Policy has been drafted in these absolute terms so that the User knows the precise extent of the User’s financial commitment before payment rather than after it, and so that the User’s decision is not founded upon an expectation the Platform does not fulfil.

This Policy shall be read together with the Terms and Conditions of Use, the Subscriptions and Invoicing Policy, the Cancellation Policy, the User Agreement, and all other legal documents of the Platform.

2. Scope of Application

This Policy applies to every amount paid to Wthaiq in respect of:

  • Subscriptions, whatever their plans and terms.
  • Electronic signature packages and their credits.
  • Artificial intelligence packages and their credits.
  • Additional services and optional features.
  • Any other paid service provided by the Platform.

This Policy does not apply to services or products supplied directly to the User by a third party; those are governed by the terms of that party.

3. Acceptance of the Policy

By completing any payment, the User acknowledges that the User has reviewed this Policy, has understood that what the User pays is non-refundable once the service has been delivered, save in the exceptional cases set out in clause 13, and has agreed to that.

This Policy is displayed or referred to before payment is completed, and no plea of ignorance of it shall be admitted after completion.

Chapter Two: The Governing Rule — No Refunds

4. Finality of Amounts Paid

Once the service has been delivered to the User's account in accordance with the Service Delivery Policy, every amount paid to Wthaiq for it is final and non-refundable, whether in whole or in part, and in any form whatsoever: in cash, as credit within the account, or by set-off against subsequent amounts due.

The return of a signature unit to the usage balance where the User withdraws a signing request before the other party opens its link, as set out in the Subscriptions and Invoicing Policy, does not constitute a refund; it is an internal usage adjustment, not a return of an amount paid.

A User's change of mind after delivery is not a ground for a refund, and amounts are returned only in the exceptional cases set out exhaustively in clause 13.

The reason for this rule is that what the Platform sells is a digital service consumed upon being made available: the credit is reserved, the usage limits are opened, and the signing, storage and evidence-retention resources are engaged from the moment of purchase, and what has been consumed of them cannot be returned.

5. Confirmatory Instances of the Rule

No amount paid shall be refunded in any of the following cases, which are given by way of illustration and not limitation:

  • Non-use of the subscription, or partial use of it.
  • Credit remaining unconsumed from signature or artificial intelligence packages upon expiry of its term or upon cancellation.
  • Cancellation of the subscription or the account before the expiry of the paid term.
  • Suspension or termination of the account by reason of the User’s breach of the Terms of Use or of the Acceptable Use Policy.
  • The User changing the User’s mind after completing the purchase.
  • Purchase of a plan or package unsuited to the User’s needs where its particulars were displayed before purchase.
  • Failure to cancel renewal before its due date in plans that include automatic renewal.

6. Cancellation Creates No Right of Refund

The User may cancel the User’s subscription or account at any time in accordance with the Cancellation Policy, and cancellation shall have the effect of stopping renewal and preventing any new financial liability from arising.

It does not, however, give rise to the return of amounts previously paid for the current term or for credits purchased. The service shall remain available to the User until the end of the paid term, unless the termination is by reason of a breach.

7. Upgrade and Downgrade

Upon an upgrade or downgrade of a plan, amounts due shall be calculated in accordance with the Subscriptions and Invoicing Policy, and a downgrade shall not give rise to the return of any difference in value or to any cash credit in respect of the higher plan paid for.

8. Promotional Credits and Granted Benefits

Free or promotional credit, and the benefits and rewards granted within campaigns or offers, have no monetary value, are not disbursed in cash, are not transferable to another account, and are not refundable in any form.

Chapter Three: What the Platform Undertakes in Return

Since the rule is absolute, its fair counterpart consists of undertakings preceding and following payment, which spare the User any need for a refund that does not occur:

9. Clarity of Price Before Purchase

The Platform displays the price of each plan or package, together with the limits and term it comprises, clearly and before payment is completed, and does not collect any amount that has not been displayed to the User and acknowledged by the User.

10. The Invoice and the Transaction Record

Every amount collected is recorded in the User’s transaction record within the User’s personal dashboard, stating its date, value, currency, the corresponding service and its status, and the User may consult it at any time.

11. Support Before and After Purchase

Before purchasing, the User may ask the support team about any aspect of the limits of a plan or package that is unclear, and the Platform shall explain what assists the User in choosing what suits the User’s needs; for a correct choice before payment is the sole alternative to a refund that does not follow it.

12. Permanent Discontinuation of a Paid Service

Should Wthaiq decide to discontinue a paid service permanently, it shall notify the affected Users a reasonable period before the discontinuation date and shall enable them to use whatever remains of their subscription or credit until that date. Discontinuation shall not give rise to the return of any amount in cash.

Chapter Four: Exceptional Cases for Returning an Amount, and Third-Party Fees

13. When and How an Amount Is Returned

The rule of this Policy relates to consideration paid for a service that has actually been delivered. It does not relate to the following cases, which are the only cases in which an amount is returned:

  • Failure to deliver: the payment succeeded but the service was not delivered to the User's account, and the Platform was unable to activate it within 24 hours of receiving the User's request under the Service Delivery Policy.
  • Duplicate charge: a single transaction was charged more than once; the excess over the single charge is returned.
  • Charge without a purchase: an amount was debited from the User with no corresponding purchase at all.

The User requests the return by writing to the support team at support@wthaiq.com, quoting the transaction reference shown on the receipt or on the payment page. The Platform verifies the transaction with the payment gateway and, if one of the above cases is established, issues the refund instruction within 5 business days of it being established; the service concerned is no longer made available after that.

The amount is returned in full to the same payment method from which it was debited — the same card through the bank, or the same PayPal account — in the same currency and without any currency conversion, and is not returned in cash or to any other payment method. It may take up to 14 business days to appear in the User's account, depending on the card-issuing bank.

14. Third-Party Fees and Currency

Wthaiq does not collect the fees of banks, card issuers or payment service providers, nor exchange-rate differences, and possesses no power to return them; these are governed by the policies of the entity that collected them.

Users in the Arab Republic of Egypt are charged in Egyptian pounds exactly as displayed to them, without currency conversion, where payment is made in Egyptian pounds. Where the User pays through the international payment gateway, the equivalent amount displayed to the User in that gateway’s currency at checkout applies, and any conversion subsequently carried out by the card-issuing bank is governed by the preceding paragraph.

Chapter Five: Bank Chargebacks

15. Contacting Support Before Raising a Chargeback

Should the User consider that an amount has been collected otherwise than as due, the better course is to contact the support team first at support@wthaiq.com, for many such cases arise from a misreading of the invoice that is clarified promptly, whereas a bank chargeback takes weeks.

16. Unjustified Chargebacks and Their Effect

Raising a bank chargeback in respect of an amount actually due for a service made available to the User constitutes a breach of this Policy, and Wthaiq may in that event, to the extent permitted by law:

  • Suspend the account or the services associated with it.
  • Withhold access to the credits and benefits that are the subject of the chargeback.
  • Restrict the payment methods used.
  • Claim any fees imposed upon it by the payment provider by reason of that chargeback.

This clause does not affect the User’s right to dispute a charge to which no purchase corresponds, as provided in clause 13.

Chapter Six: Final Provisions

17. Relationship with the Other Documents

This Policy shall be read together with the Subscriptions and Invoicing Policy and the Cancellation Policy. Where another document contains anything suggesting a right to a refund, what is provided in this Policy shall prevail, it being the document most specific to this matter.

18. Mandatory Rights Conferred by Law

This Policy is not intended to exclude or restrict any mandatory right, incapable of being derogated from by agreement, conferred upon the User by the consumer protection law or the payments law applicable to the User.

Within the limits of that conflict alone the mandatory provisions shall apply, and the remaining provisions of this Policy shall remain in force.

19. Amendment of the Policy

Wthaiq may amend this Policy, and the amended version shall be published on the website. Amendments shall apply only to purchases made after their effective date, and shall not alter the treatment of a transaction completed before it.

20. Severability

Should any provision of this Policy become invalid or unenforceable under the law, the remaining provisions shall remain in force, and that provision shall be given effect in the closest lawful sense achieving its purpose.

21. Retention of Records

Wthaiq shall retain records of payments and related correspondence for the period necessary to comply with its legal and accounting obligations, or to defend its rights in any dispute.

22. Authoritative Language and Official Version

The Arabic version published on the Wthaiq website is the official and binding version of this Policy and supersedes every previous version as from its effective date. Any version in another language is provided for convenience only, and the Arabic text prevails in the event of a difference of interpretation.

23. Contact

Enquiries regarding this Policy or a particular invoice shall be made by email to support@wthaiq.com, and the Platform may request proof of the account holder’s identity before examining any enquiry relating to payments.

24. Entry into Force and Final Acknowledgement

This Policy applies as from the effective date stated at its head, and to every payment made after it.

The User acknowledges having read this Policy and understood its effect: that what the User pays to Wthaiq is final and non-refundable once the service has been delivered, save in the exceptional cases set out in clause 13, and that the User must verify the User’s choice before completing payment.

Governing Law and Jurisdiction

This document shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and the competent Egyptian courts shall have jurisdiction to determine any dispute arising out of or relating to it; any arbitration — if agreed upon by the parties — shall likewise be conducted within the Arab Republic of Egypt and in accordance with its laws, without prejudice to any mandatory rights conferred upon the User by the applicable laws of the User’s country of residence.
