Chapter One: General Provisions

1. Introduction

This Cancellation Policy (the "Policy") governs the provisions relating to the cancellation of subscriptions and paid services, the deletion of accounts and the termination of access to the services of Wthaiq, and sets out the legal and operational effects arising from cancellation.

This Policy is to be read together with the Terms and Conditions of Use, the Subscriptions and Billing Policy, the Refund Policy, the User Agreement, and all other legal policies of Wthaiq.

2. Scope of application

This Policy applies to:

  • All paid subscriptions.
  • Free accounts.
  • Corporate accounts.
  • Additional services.
  • Electronic signature packages.
  • Artificial intelligence packages.
  • Any other service provided by Wthaiq that includes the possibility of cancellation.

3. Acceptance of the Policy

By using any service or purchasing any subscription, the User acknowledges that he has reviewed this Policy, has understood it, and has agreed to be bound by it.

4. Relationship with the Refund Policy

The cancellation of a subscription or of an account does not, of itself, give rise to any right to a refund of the fees.

All requests for the refund of amounts paid are subject to the provisions of the Refund Policy and to the applicable laws.


Chapter Two: Cancellation of the Subscription

5. The User's right to cancel

The User may cancel his subscription at any time through the means provided by Wthaiq.

The submission of a cancellation request does not affect the fees due in respect of previous periods or any outstanding financial obligations.

6. Date on which cancellation takes effect

Unless the plan or the law provides otherwise, cancellation takes effect as from the end of the current billing cycle.

The User may continue to use the services covered by the subscription until the end of that cycle, without additional fees being charged in respect of the cancelled period.

7. Discontinuation of automatic renewal

If the subscription renews automatically, cancellation of the subscription results in the discontinuation of automatic renewal for future cycles.

This does not affect the current subscription cycle for which the fees have already been paid, unless the Refund Policy or the law provides otherwise.

8. Reactivation of the subscription

The User may reactivate his subscription at any time if the plan is still available.

The prices and terms in force at the time of reactivation shall apply, unless Wthaiq agrees otherwise in writing.


Chapter Three: Cancellation of Services

9. Additional services

The User may cancel the additional services or features provided by Wthaiq, in accordance with the terms specific to each service.

Cancellation may result in the loss of access to that service or feature as from the date specified for the cancellation.

10. Standalone packages

Where certain services are purchased in the form of standalone packages, the cancellation of one of the packages does not automatically result in the cancellation of the remaining services or subscriptions, unless otherwise provided.

11. Consumed services

The cancellation of a service does not result in the recovery of any credit or usage consumed before the date of cancellation, unless the law or the Refund Policy provides otherwise.

12. Future services

If the cancelled service includes future benefits or features the use of which has not yet begun, the User's right to benefit from them ends as from the date on which the cancellation takes effect, unless Wthaiq announces otherwise.

Chapter Four: Deletion of the Account

13. Request for deletion of the account

The User may request the deletion of his account at any time through the official means provided by Wthaiq, subject to the legal and contractual obligations and to the data retention policies.

14. Identity verification

The Platform may request additional information or documents in order to verify the identity of the person submitting the account deletion request before the request is carried out, so as to protect accounts and prevent unauthorised deletion.

15. Effects of deletion of the account

The deletion of the account may result, according to the nature of the services used, in:

  • Termination of access to the Services.
  • The deletion or archiving of certain data in accordance with the Data Retention Policy.
  • The cancellation of active subscriptions, where this is possible.
  • The loss of access to stored documents after the expiry of the prescribed retention period.
  • The deletion of the account settings and preferences.
  • The deletion of the account does not affect the legal or financial obligations that arose before the deletion.

16. Retained data

Even after the deletion of the account, Wthaiq may retain certain data where this is necessary for:

  • Compliance with the laws.
  • Tax or accounting obligations.
  • The protection of legal rights.
  • The resolution of disputes.
  • The prevention of fraud.
  • Cybersecurity requirements.
  • Such data is retained only for the period permitted or required by law.

Chapter Five: Cancellation by Wthaiq

17. Termination of the subscription

Wthaiq may terminate or cancel the subscription or suspend the Services if:

  • The User has breached the Terms and Conditions of Use.
  • He has breached this Policy or any other policy.
  • He has not paid the fees due.
  • He has used the Services in an unlawful manner.
  • The Platform has become subject to legal or regulatory requirements that so necessitate.

18. Temporary suspension

The Platform may temporarily suspend the account or certain services during the investigation of a potential violation, a security incident or a financial dispute, without such suspension being regarded as a definitive termination of the account.

19. Termination of services

Wthaiq may terminate a particular service or permanently discontinue its provision for operational, commercial or legal reasons.

In such a case, the Platform shall deal with the existing subscriptions in accordance with the Subscriptions and Billing Policy, the Refund Policy and the applicable law.

20. Notices

Where this is appropriate or required by law, Wthaiq makes reasonable efforts to notify the User before the cancellation, termination or suspension, unless a security, legal or regulatory reason prevents this.


Chapter Six: Effects of Cancellation

21. Expiry of access

Upon the cancellation taking effect or the expiry of the subscription, the User loses the right of access to the services or features that were associated with that subscription, save for what Wthaiq may make available under the free plan or in accordance with other published terms.

22. Documents and data

Documents or data may continue to be available for a transitional period if the plan or the Data Retention Policy so provides.

After the expiry of that period, the data may be deleted or archived in accordance with the policies in force.

23. Re-subscription

If the User subscribes again after cancellation, Wthaiq does not guarantee the restoration of all previous data, settings or features, unless these are preserved in accordance with the Data Retention Policy.

24. Survival of certain obligations

Cancellation or deletion of the account does not terminate the obligations whose purpose requires their continuation, including:

  • Payment of the fees due.
  • The obligations relating to intellectual property.
  • Confidentiality.
  • Limits of liability.
  • Indemnification.
  • Dispute resolution.
  • Record keeping, to the extent permitted by law.

Chapter Seven: Corporate Accounts

25. Cancellation of corporate accounts

Where the subscription is owned by a company or an institution, no authorised user may cancel the subscription or terminate the account unless he is empowered to do so by the account owner or the approved administrator.

26. Effect of cancellation on authorised users

The cancellation of the subscription or the termination of the corporate account results in the termination or restriction of the access of all authorised users to the services associated with that account, unless Wthaiq provides for a different mechanism.

27. Transfer of data before cancellation

It is the responsibility of the account owner to download or export any data, documents or records he requires before the cancellation takes effect, within the period made available by the Platform.

Wthaiq does not guarantee the continued availability of the data after the expiry of that period.


Chapter Eight: Reactivation

28. Reactivation of the account

The User may request the reactivation of the account if it has not been permanently deleted, in accordance with the procedures adopted by Wthaiq.

The Platform is not obliged to approve all reactivation requests.

29. Restoration of data

If the account is reactivated, Wthaiq may be able to restore certain data or settings if these are still preserved in accordance with the Data Retention Policy.

The Platform gives no guarantee of the restoration of all data, files or records.

30. New prices

If the subscription is reactivated after its expiry, the prices, plans and terms in force at the time of reactivation shall apply, unless Wthaiq agrees otherwise in writing.


Chapter Nine: General Provisions

31. No misuse of cancellation

It is prohibited to use the cancellation, account deletion or re-subscription procedures in order to circumvent:

  • Usage limits.
  • Fees.
  • Technical restrictions.
  • Trial periods.
  • Promotional offers.
  • Any other contractual obligations.
  • The Platform may take the appropriate measures upon discovering any misuse.

32. Amendment of the Policy

Wthaiq may amend the Cancellation Policy at any time if legal, operational or commercial necessity so requires.

Amendments take effect from the date of their publication or from the date specified in them, and continued use of the Services thereafter is deemed to be acceptance of them, to the extent permitted by law.

33. Severability of provisions

If any provision of this Policy becomes invalid or unenforceable under the law, this shall not affect the validity or enforceability of the remaining provisions.

34. Survival of certain provisions

The provisions relating to fees, data retention, intellectual property, confidentiality, limits of liability, indemnification, dispute resolution, and any provisions whose purpose requires their continuation, remain in force after cancellation or deletion of the account, to the extent necessary.

35. Contact

The User may contact Wthaiq through the official channels of communication published on the website for enquiries relating to cancellation, deletion of the account or termination of subscriptions.

The Platform may request additional information in order to verify the identity of the person submitting the request before carrying out any measure.

36. Entry into force

This Cancellation Policy enters into force as from the date shown at its beginning, and remains in effect until it is amended or replaced, and continued use of the services of Wthaiq is deemed to be agreement to its provisions, to the extent permitted by law.


Governing Law and Jurisdiction

This document shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and the competent Egyptian courts shall have jurisdiction to determine any dispute arising out of or relating to it, and any arbitration — if agreed upon by the two parties — shall be conducted within the Arab Republic of Egypt and in accordance with its laws, without prejudice to any mandatory rights afforded to the User under the applicable laws of his country of residence.
