Chapter One: General Provisions

1. Introduction

This Refund Policy (the “Policy”) governs the cases in which the User may request a refund of the amounts paid for the services or subscriptions provided by Wthaiq, and sets out the procedures, restrictions and controls relating to the processing of refund requests.

This Policy shall be read together with the Terms and Conditions of Use, the Subscriptions and Invoicing Policy, the User Agreement, and all other legal documents of the Platform.

2. Scope of Application

This Policy applies to all payments made in respect of:

  • Subscriptions.
  • Additional services.
  • Optional features.
  • Electronic signature packages.
  • Artificial intelligence packages.
  • Any other paid services provided by Wthaiq.

This Policy does not apply to any services or products supplied directly by third parties, unless Wthaiq expressly states otherwise.

3. Acceptance of the Policy

By completing any purchase or subscription, the User acknowledges that the User has read this Refund Policy, has understood it and has agreed to it.

4. General Principle

Wthaiq undertakes to consider refund requests in good faith, having regard to the applicable laws, the nature of the digital services provided, the actual use of the service, and the provisions of this Policy.

The submission of a refund request shall not be deemed a guarantee of its approval.


Chapter Two: Cases of Refund

5. Cases in Which a Refund May Be Approved

Wthaiq may, or shall be obliged to where the law so requires, approve a refund request in cases such as:

  • The collection of an amount as a result of a technical or accounting error.
  • The repeated deduction of the amount for the same transaction.
  • The impossibility of activating the service owing to an error on the part of the Platform.
  • The inability to provide the service for reasons attributable to Wthaiq.
  • Any other case which the Platform considers to warrant a refund or which the law requires.

6. Partial Refund

The Platform may, according to the circumstances of each case, approve a partial refund if:

  • The User has benefited from part of the service.
  • Certain features have been used before the refund request.
  • Part of the fees was non-refundable under this Policy.
  • Contractual fairness or the law so requires.

7. Mandatory Refund

If the applicable law grants the User a mandatory right to a refund of a particular amount, Wthaiq shall comply with that right within the limits imposed by the law.

No provision of this Policy is intended to restrict or cancel any mandatory rights that may not be derogated from by agreement.


Chapter Three: Non-Refundable Cases

8. Digital Services That Have Been Used

Unless the law requires otherwise, the User shall not be entitled to a refund of the fees if the User:

  • Has begun to use the paid service.
  • Has benefited from the subscription.
  • Has used the artificial intelligence packages.
  • Has used the electronic signature credit.
  • Has used the additional services that have been activated.

9. Misuse

A refund request may be refused if it becomes apparent that the User:

  • Has misused the Services.
  • Has breached the terms of use.
  • Has circumvented the subscription systems.
  • Has used fraudulent means.
  • Has provided misleading information relating to the refund request.

10. Promotional Offers

Subscriptions or services purchased under promotional offers, discounts or special prices may be subject to different refund terms, which are set out when the offer is presented.

11. Third-Party Charges

Wthaiq bears no responsibility for refunding the charges imposed by:

  • The bank.
  • The card issuer.
  • The payment service provider.
  • Currency conversion charges.
  • Governmental or banking charges that the Platform does not collect directly.
  • The refund of such charges is subject to the policies of the entity that collected them.

Chapter Four: Refund Request Procedures

12. Submission of a Refund Request

The User may submit a refund request through the official means designated by Wthaiq, providing the Platform with the information necessary to consider the request, which may include:

  • The account number.
  • The registered email address.
  • The invoice number or the payment transaction number.
  • The reason for the refund request.
  • Any supporting documents or information.

13. Verification of the Request

The Platform may request additional information or documents in order to verify the validity of the request and the identity of the applicant before taking any decision regarding the refund.

Consideration of the request may be suspended pending receipt of the requested information.

14. Time for Considering the Request

Wthaiq endeavours to consider refund requests within a reasonable period, having regard to the nature of the request, the volume of transactions, the legal requirements, and any necessary verification procedures.

The lapse of any particular indicative period shall not be deemed an acknowledgement of the approval or the refusal of the request.

15. The Refund Decision

Upon completing its consideration of the request, the Platform may:

  • Approve the refund in full.
  • Approve a partial refund.
  • Refuse the request, stating the reason, where that is appropriate or required by law.
  • The Platform’s decision shall be based on this Policy, the contractual documents and the applicable laws.

Chapter Five: Execution of the Refund

16. Means of Refund

If a refund request is approved, Wthaiq may return the amount using:

  • The original means of payment.
  • A credit within the account, if the User agrees or if that is available.
  • Any other means permitted by law or agreed between the parties.

17. Time for Executing the Refund

After a refund request has been approved, Wthaiq shall make reasonable efforts to remit the amount due within an appropriate period.

The time taken for the amount to reach the User may vary according to:

  • The bank.
  • The payment service provider.
  • The country.
  • The means of payment used.

Wthaiq bears no liability for any delay caused by the financial institutions or the payment service providers after the refund transaction has been sent.

18. Currency

The refund shall be executed, wherever possible, in the currency in which the original payment was made.

The final value received by the User may differ as a result of:

  • Exchange rate differences.
  • Bank charges.
  • Payment service provider charges.
  • Wthaiq bears no liability for those differences or for the charges that are beyond its control.

Chapter Six: Special Cases

19. Duplicate Deductions

If the value of a subscription or a service has been deducted more than once owing to a technical or operational error, Wthaiq shall, after verifying the occurrence, refund the excess amount or make the appropriate settlement.

20. Fraud

Any refund request may be refused if Wthaiq has reasonable grounds to believe that:

  • The payment transaction was carried out fraudulently.
  • The means of payment was used without authorisation.
  • Forged information or documents have been submitted.
  • The request is intended to misuse the Refund Policy.

In such cases, the Platform may suspend the account or take the appropriate legal action, subject to the applicable law.

21. Repeated Refund Requests

If it becomes apparent that the User is submitting repeated refund requests without justification or in a manner that constitutes misuse, the Platform may:

  • Request additional information.
  • Refuse certain requests that are not due.
  • Restrict certain means of payment.
  • Suspend the Services or the account, where the breach is serious or repeated.

Chapter Seven: General Provisions

22. Relationship with the Subscriptions and Invoicing Policy

The Refund Policy shall be read together with the Subscriptions and Invoicing Policy, and in the event of a conflict, the document that is more specific to the matter in dispute shall apply, unless the law requires otherwise.

23. Amendment of the Policy

Wthaiq may amend the Refund Policy at any time where legal, operational or commercial necessity so requires.

Amendments shall apply to new requests as from their effective date, unless the law requires otherwise.

24. Severability of Provisions

If any provision of this Policy becomes ineffective or incapable of enforcement under the law, that shall not affect the validity or the effectiveness of the remaining provisions.

25. Entry into Force

This Refund Policy enters into force as of the date set out at its beginning, and shall remain applicable to all purchases made after that date, unless the law requires the application of different provisions.

26. Final Acknowledgement

The User acknowledges that the User has read the Refund Policy, has understood the cases in which a refund of the fees may be requested and the cases in which it may not, and agrees to comply with this Policy when using any of the paid services provided by Wthaiq.

Chapter Eight: Advanced Financial Provisions

27. Refunds in the Case of an Upgrade or a Downgrade

If the User upgrades or downgrades the User’s subscription plan, any amounts due, credits or differences shall be calculated in accordance with the Subscriptions and Invoicing Policy, and this shall not give rise to an automatic refund unless Wthaiq or the law provides otherwise.

28. Services Provided by Third Parties

If a purchase includes services, products or charges pertaining to third parties, the refund of those amounts shall be subject, in addition to this Policy, to the terms of the entity providing the service, to the extent permitted by law.

29. Refunds Owing to the Permanent Discontinuation of a Service

If Wthaiq decides to discontinue a paid service definitively and is unable to provide the remaining part of it, it may, at its discretion or if the law so requires, refund the value of the unused part, provide a suitable alternative, or provide a credit within the Platform.

30. Promotional Credit

No free or promotional credit, rewards or balances granted as part of marketing campaigns may be refunded in cash, unless the terms of the offer or the law provide otherwise.


Chapter Nine: Disputes Relating to Payments

31. Contact Before a Bank Dispute

Wthaiq encourages the User to contact the support team before submitting any dispute to the bank or to the payment service provider, so as to allow an opportunity to resolve the problem promptly.

This clause does not limit any mandatory right conferred upon the User by law.

32. Disputes Relating to Refund Transactions

If a dispute arises concerning a refund request, the Platform may request any information or documents that it considers necessary in order to verify the facts, and the determination of the request may be suspended pending completion of the review.

33. Misuse of the Refund Policy

Wthaiq may refuse any request or take appropriate action if it becomes apparent that there is misuse of the Refund Policy, including:

  • The provision of incorrect information.
  • The submission of repeated requests without justification.
  • The use of requests for the purpose of obtaining services without consideration.
  • The misuse of bank dispute procedures (Chargeback).

Chapter Ten: Concluding Provisions

34. No Waiver

Wthaiq’s acceptance of any refund request in a particular case shall not be deemed an undertaking to accept similar requests in the future; each case shall be considered according to its own circumstances, this Policy and the applicable law.

35. Survival of Certain Provisions

The provisions relating to payments, verification, the combating of fraud, the settlement of disputes and financial obligations shall remain in force after the termination of the account or the expiry of the subscription, to the extent necessary.

36. Final Acknowledgement

The User acknowledges that the User:

  • Has reviewed the Refund Policy.
  • Has understood the cases in which a refund of the fees may be requested.

Understands that certain digital services may become non-refundable after their use has begun, to the extent permitted by law.

Agrees to comply with this Policy when purchasing or using any paid service provided by Wthaiq.

Chapter Eleven: Provisions Specific to Refunds

37. Expired or Cancelled Means of Payment

If it is not possible to return the amount to the original means of payment because it has expired, has been cancelled, or because the payment provider has rejected the transaction, Wthaiq may, to the extent permitted by law, agree with the User on a suitable alternative means of refund.

38. Refunds in Cases of Confirmed Fraud

If it is established that a payment transaction was made as a result of the unauthorised use of a means of payment or as a result of confirmed fraud, Wthaiq reserves its right to cooperate with the competent authorities and with the payment service provider, and the refund procedures may be suspended pending completion of the verification, where that is legally permissible.

39. Effect of a Refund on the Services

If a refund of the value of a subscription or a service is approved, Wthaiq may:

  • Terminate the subscription that is the subject of the refund.
  • Cancel access to the service associated with it.
  • Cancel any features granted in consideration of the refunded amount.
  • Adjust the usage limits in line with the status of the account after the refund.

40. Repeated Misuse

If it becomes apparent that the User is misusing the Refund Policy repeatedly or systematically, the Platform may, to the extent permitted by law:

  • Refuse future requests that are not due.
  • Impose additional verification measures.
  • Suspend certain means of payment.
  • Suspend or terminate the account where there is a serious breach.

Chapter Twelve: Additional Concluding Provisions

41. Independence of Refund Requests

Each refund request shall be assessed independently according to its own circumstances, and the acceptance or refusal of any previous request shall not create a right or a binding precedent in respect of other requests.

42. No Waiver of Rights

Wthaiq’s delay in exercising any right relating to refund requests, or its refraining from exercising it in a particular case, shall not be deemed a waiver of that right in any subsequent case.

43. Compliance with Laws

This Policy shall apply to the extent that it does not conflict with the mandatory laws and regulations relating to consumer protection, electronic payments or digital services in the State to which the User is subject.

In the event of a conflict, the mandatory provisions of that law shall apply within the limits of the conflict only.

44. Retention of Records

Wthaiq may retain records of refund requests, of the correspondence and of the decisions relating to them for the period necessary to comply with legal or accounting obligations or to defend its rights in any dispute.

45. The Approved Language

If the Refund Policy is made available in more than one language, the version adopted by Wthaiq as the official version shall be the reference for interpretation, to the extent permitted by law.

46. Contact

The User may submit refund requests or enquiries relating to this Policy through the official means of communication published on the Wthaiq website.

The Platform may request additional information in order to verify the identity of the applicant before processing any request.

47. The Official Version

The version published on the Wthaiq website shall be the official and most recent version of the Refund Policy, and shall supersede any previous version as from its effective date.

48. Application of the Policy

This Policy applies to all purchases made from its effective date, and also applies to any refund requests submitted after that date, unless the law requires the application of different provisions.

49. Survival of Certain Provisions

The provisions relating to fees, verification, the combating of fraud, the settlement of disputes, financial obligations, and any provisions the purpose of which requires their continuation, shall remain in force after the termination of the account or the expiry of the subscription, to the extent necessary.

50. Final Acknowledgement

The User acknowledges that the User has read and understood the Refund Policy, that the User appreciates the nature of the digital services provided by Wthaiq, and agrees that the processing of any refund request shall take place in accordance with this Policy, the Terms and Conditions of Use, and the applicable law.


Governing Law and Jurisdiction

This document shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and the competent Egyptian courts shall have jurisdiction to determine any dispute arising out of it or relating to it; and any arbitration — if the parties so agree — shall be conducted within the Arab Republic of Egypt and in accordance with its laws, without prejudice to any mandatory rights conferred upon the User by the applicable laws of the User’s country of residence.
