This Electronic Signature Policy (“the Policy”) governs the use of the electronic signature services provided by Wthaiq (“the Platform”, “we”, “us”), and sets out the controls, procedures, rights and obligations relating to the creation of electronic signatures, the management of electronic documents, the verification of signing operations, and the retention of the records thereof.
This Policy is to be read together with the Terms and Conditions of Use, the Privacy Policy, the User Agreement, the Licence Agreement, and the remaining legal documents of Wthaiq.
This Policy applies to all electronic signature services provided by Wthaiq, including:
By using the electronic signature services, the User acknowledges that they have reviewed this Policy, understood it, and agreed to be bound by its provisions.
This Policy applies to the extent that it does not conflict with the applicable laws and regulations concerning electronic signatures and electronic transactions.
In the event of a conflict, precedence shall be given to the mandatory provisions imposed by the competent law.
An electronic signature means any data, code or electronic procedure used by a person with the intention of signing an electronic document, or of demonstrating their approval, acceptance or acknowledgement of the content of that document, in accordance with the applicable law.
An electronic document means any file, record, contract, form, message or any content that is created, sent, signed or stored using the services of Wthaiq.
The signatory is the natural or legal person who uses the services of Wthaiq to sign, approve or endorse an electronic document.
The audit trail is the electronic record created by Wthaiq to document the events relating to the signing process, and it may include, depending on the nature of the service:
The user of the electronic signature service must be legally or contractually authorised to sign the documents for which they use the service.
It falls upon the User to ensure that they hold the necessary powers before carrying out any signature.
The signatory acknowledges that they are responsible for:
The signatory bears responsibility for reviewing the content of the document in full before signing it.
Wthaiq does not bear liability for the content of the documents, for the correctness of the information contained in them, or for the legal effects arising from their substance.
It is prohibited to use the electronic signature service for any unlawful purpose, or any purpose that contravenes the law, the Terms and Conditions of Use, or the Acceptable Use Policy of Wthaiq.
Wthaiq may use appropriate means of verification to confirm the identity of signatories, according to the nature of the service, the plan, or the legal or contractual requirements.

The User bears responsibility for the correctness of the identity data that they provide when using the electronic signature services.
Wthaiq does not bear liability for any incorrect or misleading data provided by the User or by any other person who uses their account.
Wthaiq records the time at which the electronic signature is carried out, using the technical systems approved by it.
The time displayed to the User may differ according to the time zone, the settings of the device, or the service used.
Wthaiq takes reasonable technical measures to help maintain the integrity of electronic documents after the signing process has been completed, in a manner proportionate to the nature of the service.
This does not constitute a guarantee that no copy may be altered outside the systems of Wthaiq or outside its control.
Wthaiq may create and retain an electronic audit trail of signing operations, which may include information such as:
The signature records and audit trails created by Wthaiq are considered part of the operational records of the Platform, and may be relied upon to evidence the performance of the operations, within the limits permitted by the law, with the final assessment of their evidentiary weight remaining a matter for the judicial or competent authority.

Wthaiq does not review, endorse or verify the correctness or the lawfulness of the content of the documents uploaded by Users.
The creator of the document and the signing parties bear full responsibility for the substance of the document and for its legal effects.
Wthaiq may retain electronic signature records, audit trails and the technical data associated with them for the period necessary to provide the services, to comply with legal obligations, or to deal with disputes, in accordance with the Data Retention Policy.
If the service or the subscription plan so permits, the User may download or export the documents, the certificates of completion or the audit trails, in accordance with the features available on the Platform.
The deletion of electronic signature records is subject to the Data Deletion Policy and the Data Retention Policy, and it may not be possible to delete certain records where their retention is required under the law or for the protection of legal rights.
The use of the electronic signature service is intended to enable the parties to conclude electronic transactions in accordance with the applicable laws.
Wthaiq does not guarantee that every document, or every type of electronic signature, will be legally recognised in all countries or before all authorities, as this is subject to the legislation in force and to the nature of the transaction.
The User bears responsibility for ensuring that the use of the electronic signature is appropriate for the intended purpose and consistent with the legal, regulatory or contractual requirements applicable to them.
Certain laws or regulations may exclude particular types of documents or legal acts from the use of the electronic signature.
Wthaiq does not bear liability for the use of its services in cases where the law prohibits the use of the electronic signature or imposes additional requirements that have not been satisfied.
If Wthaiq makes available an electronic seals service or organisation seals, their use shall be subject to the terms specific to that service and to the applicable laws.
If Wthaiq supports the use of digital certificates or of services provided by certificate issuing bodies (Certification Authorities), the relationship between the User and those bodies shall also be subject to the terms and conditions of those bodies, and Wthaiq does not bear liability for the services that they provide independently.
Wthaiq may provide application programming interfaces (APIs) or means of integration with external systems or services for the management of electronic signature operations.
The User remains responsible for the sound use of those external systems and for compliance with the terms governing them.
Wthaiq may amend the Electronic Signature Policy at any time where legal, technical or operational necessity so requires.
Amendments take effect from the date of their publication or from the date specified therein, in accordance with what the law permits.
If any provision of this Policy becomes invalid or unenforceable under the law, this shall not affect the validity or enforceability of the remaining provisions.
This Policy shall be construed together with the Terms and Conditions of Use, the Privacy Policy, the User Agreement, the Licence Agreement, the Data Retention Policy, the Data Deletion Policy, and the remaining legal documents of Wthaiq, as an integrated legal framework.
The User may contact Wthaiq through the official means of communication published on the website for enquiries relating to the electronic signature services.
The Platform may request additional information in order to verify the identity of the applicant before processing any enquiry or request.
This Electronic Signature Policy enters into force as of the date shown at its beginning, and remains in effect until it is amended or replaced in accordance with its provisions.
The User acknowledges that they have reviewed the Electronic Signature Policy, and that they have understood the nature of the services provided by Wthaiq, and agrees to be bound by its provisions when using the electronic signature services, to the extent permitted by the law.
This document shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and jurisdiction shall lie with the competent Egyptian courts to determine any dispute arising out of or relating to it; any arbitration — if agreed upon by the two parties — shall likewise be conducted within the Arab Republic of Egypt and in accordance with its laws, without prejudice to any mandatory rights afforded to the User under the applicable laws of their country of residence.
